Halifax Deck Building Code: What HRM's Deck Guide Requires
Whether a deck is safe comes down to a few details: guards tall enough to stop a fall, stairs with even risers, and posts on footings that do not heave every spring. All three are covered by rules that are easy to find once you know where to look.

Which Code Applies to Decks in Halifax
HRM does not write its own building code. Construction in the municipality falls under the Nova Scotia Building Code Regulations, which adopt the National Building Code of Canada 2020 with provincial amendments. That edition has been in force in Nova Scotia since April 1, 2025, and the provincial amendments do not change the deck guard, stair or handrail rules.
The code treats a deck as part of a building, so its footings, framing and guards are held to the same Part 9 rules as a house. On top of the code, HRM publishes a two page Decks guide (dated September 2023) linked from its deck permit page on halifax.ca. It gives the figures HRM expects to see on a deck permit application, plus span tables for joists and beams.
Footings and Frost Depth
HRM's guide answers the footing question directly. You need footings if the deck is attached to the house, and you also need them if the deck is detached and more than 2 feet above grade. Those footings must reach at least 4 feet (1.2 m) below grade for frost protection.
For the footing itself, the guide gives two options:
- A 10 inch sonotube on a 24 inch by 24 inch column pad
- A "big foot" style footing combined with a sonotube
Engineered helical (screw) piles are also common here, especially where digging 4 feet is impractical. Your drawings need to show what you are using and how deep it goes. Where bedrock sits near the surface, as it does across much of HRM, talk to the building official before you design around it.
Wood columns carrying a wood beam must be at least 6 x 6 inches (140 mm by 140 mm), and HRM's application lists a maximum of 8 feet (2.4 m) between posts.
Joist and Beam Spans
HRM's guide includes span tables for joists and built-up beams. Span depends on lumber size, spacing, species and grade, and the guide does not state which species and grade its figures assume, so we do not reprint them here. Use the tables in HRM's guide as a ceiling, not a target, and size your framing for the lumber you actually buy. The guide measures "supported joist length" as half the joist spans on both sides of a beam, and all joist and beam lumber must carry a grade stamp.
Composite decking often calls for tighter joist spacing than wood, so check the board manufacturer's instructions before you frame.
Attaching the Deck to the House
The building code has no step by step deck ledger schedule, and HRM's guide simply asks for connection details on your plans. In practice the building official wants to see how the ledger or beam connects to the house framing, what fasteners are used, and how water is kept out of the wall behind it.
A ledger is normally bolted through to the house's rim joist and flashed above. It should never hang off brick veneer or off siding alone. If the house framing cannot take the load, a freestanding deck with its own beam and posts next to the wall avoids the problem, though it still needs frost-protected footings if it stands more than 2 feet above grade.
Guards: When You Need Them and How High
Under the National Building Code, a guard is required on any open side of a deck, landing or stair where the drop is more than 600 mm (about 24 inches) to the surface within 1.2 m of the edge. HRM's guide sets the heights for a house deck:
- Deck 6 feet or less above the ground: guard at least 36 inches (900 mm)
- Deck more than 6 feet above the ground: guard at least 42 inches (1,070 mm)
Those match the code, which allows the lower 900 mm guard only where the walking surface is no more than 1,800 mm above finished ground. Because the test is the height of the walking surface, the safe approach on a sloped lot is to build the whole guard to 42 inches if any part of the deck is more than 6 feet up, and to confirm with the building official before you order railings.
Baluster spacing and openings
Openings in a guard must stop a 4 inch (100 mm) sphere, the same limit HRM lists. On stairs, the triangle formed by the tread, the riser and the bottom rail must stop a 150 mm (about 6 inch) sphere. On a deck more than 4.2 m (about 14 feet) above the level below, the guard also cannot have rails or other parts between 140 mm and 900 mm off the deck that a child could climb.
Deck Stairs and Handrails
Stairs serving a single house are "private stairs" in the code. For rectangular treads:
- Rise: 125 mm to 200 mm (about 5 to 7 7/8 inches)
- Run: 255 mm to 355 mm (about 10 to 14 inches)
- Tread depth: at least the run, and no more than 25 mm longer
- Single flight: no more than 3.7 m of vertical height
Exterior stairs for one house do not need a handrail if they have 3 risers or fewer. With more than 3 risers, one handrail is enough. Required handrails must sit 865 mm to 1,070 mm (about 34 to 42 inches) above the line of the tread nosings. Any open side of the stair with more than a 600 mm drop also needs a guard.
Setbacks, Lot Coverage and Watercourses
Setbacks and lot coverage come from your zone's land use by-law, not the building code, and they vary across HRM. HRM notes that the rules can differ for attached and freestanding decks and with deck height. Look up your zone on HRM's property information map first. Your site plan must show distances to every property line and any watercourse buffer. HRM's guide also says a lot grading permit is required for a deck in Bedford.
Permits, in Short
HRM requires a deck permit to build a new deck or replace an existing one, and the permit is good for 2 years. Expect at least a footing inspection and a final inspection, depending on the size of the deck and how it connects to the house. Frequently Asked Questions
What deck height can I build without a permit in HRM?
HRM lists no height exemption. A new deck needs a permit whatever its height. Height only changes the footing rule (detached decks over 2 feet need 4 foot footings) and the guard rules.
Is a permit required to build a deck in HRM if it's under $5,000?
We could not find a dollar threshold for decks in the Nova Scotia Building Code Regulations or HRM's building by-law, and HRM's deck page lists none. The project value affects your permit fee, not whether you need a permit.
Do I need a permit to replace an existing deck?
Yes. HRM names replacing an existing deck as work that needs a deck permit, and the new deck is reviewed against the current code. If you are only swapping a few boards with no structural work, confirm with HRM before you start.
Does a floating deck need a permit?
HRM does not exempt floating decks from the deck permit. What changes is the footing rule: a detached deck 2 feet or less above grade does not need 4 foot footings under HRM's guide. If the drop at every edge is 600 mm or less, it also needs no guard.
